Recent updates in real estate broker compensation and representation are paving the way for a new era in transactions for buyers and sellers nationwide. The NAR Settlement

In October 2023, a federal jury determined that the National Association of Realtors (NAR) violated antitrust laws by making home sellers cover both the seller and buyer broker commissions. Despite some media confusion, it’s important to note that broker fees have always been negotiable, and sellers have never been required to pay these fees.

How Compensation Worked Before the Settlement

Seller-paid buyer broker commissions were created to ensure equitable access to professional representation and fair housing opportunities for buyers. Before the recent changes, sellers typically paid a negotiable commission of the home’s sale price, allowing it to be split between the seller’s broker and the buyer’s broker. This system made home buying more affordable and professional representation accessible by including broker fees in the offer price, eliminating the need for buyers to pay their broker out of pocket in addition to their down payment, closing costs, etc. It also helped sellers attract more buyers and generate competitive offers, especially in competitive markets like Marin. This approach ensured buyers received proper representation and facilitated smoother transactions while reducing legal risks for everyone involved.

The New Rules

The recent settlement introduces changes to enhance transparency and fairness. Effective August 17, 2024, here’s what you need to know:

For Home Sellers

  • Negotiable Compensation: Compensation for your broker and the buyer’s broker remains negotiable. The new rules focus on transparency, allowing you to decide whether to offer buyer’s broker compensation based on your sales strategy. We’re here to discuss your options and our fees openly.

  • Advertising Compensation: Compensation offers to the buyer’s broker will no longer appear on the MLS. However, there are other effective ways to communicate compensation.

  • New Selling Strategies: Work with us to understand the best practices for compensation and how these changes might impact your sale. Each home is unique and the structure of compensation offered to the buyer’s broker could impact a buyer’s ability to buy your home. We’re here to help you tailor strategies to meet your goals.

For Home Buyers

  • Buyer Representation Agreements: Before touring homes, you’ll need to select an agent and sign a Buyer Representation Agreement. This agreement establishes your relationship, outlines the fees and services provided, and how your broker will be compensated.

  • Understanding Representation: It is essential to understand the benefits of having professional representation, the services your broker offers, and their fees.

  • Compensation Clarity: For each property you're interested in, you'll want to know how the seller is handling your broker's compensation. If the seller does not offer to cover the fee, you will pay your broker directly per your Buyer Representation Agreement. You will still have the opportunity to negotiate who will cover your broker’s fee as part of your offer.

  • New Offer Strategies: There are various ways your broker can be compensated. We’ll guide you in understanding the competitive landscape of each property and developing the best strategy to get your offer accepted.

  • Financial Planning: If you’re responsible for covering your broker’s fee out-of-pocket, factor this into your offer strategy and budget planning.

  • Ethical Standards: Realtors® continue to uphold their commitment to acting in your best interests and adhering to a strict code of ethics.

  • Negotiability: Broker compensation remains negotiable. Broker fees reflect the services provided and value they bring to your real estate experience, just like any other professional service.

  • You Have Choices: You still have the freedom to choose whether to work with a Realtor®, an attorney, or to buy/sell without representation. Each option comes with its own risks and rewards. It’s important to understand which approach best aligns with your real estate goals based on your niche market.
